The plaintiff commenced this action in January, 1963, to recover for injuries allegedly resulting from a fall in a building
owned by the defendant. The jury found that the plaintiff was 60 percent negligent and the defendant was 40 percent negligent. As his sole contention on this appeal, the appellant urges that the defendant's counsel committed reversible error in the
final argument when he referred to the plaintiff as a Nazi. It appears in the record that the plaintiff had fought against
the United States as a German soldier during World War II and that he is now an American citizen.
